In NSW, the Planning Act, the POEO Act and various other Acts entitle “any person” to commence court proceedings seeking an order to remedy or restrain a breach of the Act, in relation to a decision concerning an application for a permit under that Act.
These include the power to investigate, to require the provision of information and/or records, to enter and search premises/land, and to question and identify persons. These powers can be exercised for the purposes of generally administering the relevant Act and protecting the environment. The power to enter and search premises/land usually includes (among other things) the power to take and remove samples, take photographs and video recordings, and seize anything which an officer has reasonable grounds for believing is connected with an offence against the relevant statute.
