The key royal decree for reforming trial procedure and introducing a state prosecutor’s office was that of January 3, 1849. This included the declaration that “no prior authorization from the government is necessary” for bringing lawsuits against the civil and military authorities: Article 95 of the Constitution of December 5, 1848. In Prussia, these reforms were instituted in two stages in 1846 and 1849. In southwestern Germany – the Rhineland (1810), Baden (1832), and Württemberg (1843) – they had occurred before the revolution.

But by the later decades of the century, injured honor was being mobilized in grassroots movements, two of which are explored in chapter 5: those of Jews and lunatics. Here, I discuss the rise in the 1890s among Jews and lunatics of a bourgeois politics from “below” that appropriated and modernized an old corporate language of honor in order to make 18 Honor, politics, and the law in imperial Germany democratic claims for the rights of citizenship. The multiple responses of Jews to the rise of political antisemitism, from conversion and assimilation to Zionism, have been explored at length in the scholarship.
